OCULTAMIENTO DE UN HEREDERO EN UN JUICIO SUCESORIO<br \/>\nNacional: C\u00e1mara Nacional de Apelaciones en lo Criminal y Correccional. Fecha resoluci\u00f3n: 07 &#8211; Mar &#8211; 2018<\/p>\n<div class=\"text_exposed_show\">\n<p>El fallo de la Sala I de la C\u00e1mara Nacional de Apelaciones en lo Criminal y Correccional de la Capital Federal en autos \u201cS., S. S. s\/procesamiento\u201d (causa n\u00b0 40.362\/2017) rta. 11\/11\/17, donde los vocales intervienen con motivo del recurso de apelaci\u00f3n interpuesto por la defensa contra el auto del juez de la instancia de origen que dispuso el procesamiento de la imputada por considerarla autora del delito de estafa procesal (art. 172 CP) al haber iniciado el juicio sucesorio de sus padres ocultando la existencia de un hermano, a partir de lo cual el juzgado civil la declar\u00f3 \u00fanica y universal heredera. Los vocales, por mayor\u00eda, confirmaron el procesamiento.<\/p>\n<p>Mauro Divito, a cuyo voto adhiri\u00f3 Juan Estaban Cicciaro, precis\u00f3 que la manifestaci\u00f3n de ser la \u00fanica y universal heredera que efectuara expresamente por escrito, constituy\u00f3 un enga\u00f1o al juez de ese proceso, el cual encuentra adecuaci\u00f3n t\u00edpica en el art\u00edculo 172 CP.
